TERMS AND CONDITIONS

1.   Acceptance of Terms and Conditions

1. No variation or addition to the Terms shall be binding unless agreed in writing by Kickeroos, Active8kids and the associated party involved.

2. The Terms shall be deemed to have been accepted at the time of registration.

 

2.   Payment and Enrolments

1. Enrolments are accepted online at www.kickeroos.com.au, www.active8kids.com.au and www.shekicks.com.au or via telephone using a credit card.

2. No part payments for enrolments can be taken.

3. Classes operate on a continual basis, payment is made quarterly by direct debit from your nominated credit card, this payment information is collected upon your first booking and payments will be taken quarterly in advance. These details are stored safely in our payment gateway.

4. 1% Credit card payment fee

5. Due to the increased cost and charges by banks, The business has made a decision to pass on bank fees in line with industry standards. Effective Monday 28 March 2022 , a credit card transactions fee of 1% will be automatically applied to every transaction and will be itemised on your receipt.

6. Dishonour fees of $8.50 per transaction will apply for any payments declined for any reason. This fee will be passed on to you before your next billing cycle.

7. If there are available places, you will be enrolled immediately

8. If there are no places available, you will be placed on a waitlist and will be advised if a place in your requested class becomes available. 

9. For all other enrolments, payment is required at the time of booking.

10. A minimum of 1 term (see schedule) prepayment is at the time of the enrolment. Non payment will place you on a wait list and this does not secure you a place in the class.

11. Classes will not operate on a public holiday.

12. If your class falls on a public holiday the cost of the term will be adjusted for the public holiday.

 

3.   Holiday Camp

1. Enrolments are accepted online at www.kickeroos.com.au, www.active8kids.com.auand www.shekicks.com.au

2. If there are available places, you will be enrolled immediately.

3. If there are no places available, you will be placed on a waitlist and will be advised if a place in your requested class becomes available. 

4. All bookings must be paid in full at the time of registration. 

5. At the conclusion of holiday camp, if a child has not been collected, an additional fee of $20 per child per 15 minutes after pick up time will be charged. This fee needs to be paid in cash at pick up.

 

4.   Wet Weather 

1. Applies to all outdoor venues.

2. We will inform you as close to your program time as possible if we will be cancelling your session due to wet weather. 

3. You will be informed via text message of any changes to your scheduled class or venue location. 

4. Failure to attend the wet weather alternative (if available) will not give rise to a make-up class or credit. 

5. Please refer to the Reschedule Policy for details about make up classes.

 

5.   Missed Session Policy

1. If you miss a session, you will forfeit the session. 

2. We offer 2 make up classes per student by you marking your child absent on your profile before the missed class. That way we can offer that class to another student.

3. Make up lessons must be used within the billing term period of the missed class.

4. Classes must be booked online and are subject to availability.

5. Missed classes cannot be used or exchanged for financial credit or refund. 

6. In the event that prior notice is not given, a make-up class will not be offered, and you will forfeit the session. 

 

6.   Cancellation and Refund 

1. All sales are final, No Refunds.

2. We offer NO refunds for any reason or circumstance UNLESS; Enrolment is cancelled at least 10 business days prior to the first day of the complete booking. In this case payment shall be refunded less the deduction of a 15% Bank/Administration Fee. Other Merchant Charges may also apply.

3. To cancel an enrolment for medical reasons a medical certificate must be supplied with written notification by email to Kickeroos or Active8kids.  Upon approval you will be provided with a pro rata Credit Note. This Credit Note is valid for 90 days and may be used for future bookings in any Kickeroos & Shekicks programs (excludes merchandise).

4. You may cancel your enrolment at any time by providing us with written notice of at least 3 business days before the scheduled automated billing date. Your cancellation will be effective on the last day of the term, Therefore, your deductions will continue until the full term’s fees are paid.

5. If notice requirements are not met, you will automatically be liable for payment of the next scheduled invoice/bill regardless of cancellation. This payment will not be refunded and Kickeroos and SheKicks reserve the right to debit/collect the authorised account for monies owed.

6. No bookings can be put on hold without full payment.

7. A 12 hour cancellation period apples for all private 1:1 sessions booked and paid for. A credit note will not be applied to any sessions where cancellations outside of these minimum hours in not met - you will need to forfeit the session.

 

7.   Change of Venue/Coach

1. You acknowledge that Kickeroos and Active8kids cannot control the use of the venues. 

2. We reserve the right to change the venue of our classes if required at any time. 

3. We shall endeavour to provide you with as much notice as possible. 

4. We reserve the right to change your coach at any time. We shall endevour to provide you with as much notice as possible.

 

8.   Player Conduct Policy 

1. All students are required to show up 10 minutes before each session to warm up with the proper soccer attire (uniform).

2. Depending on enrolled programs, All students are to arrive with water bottle at all times.

3. When required by the enrolled program or as specified by Kickeroos and Active8kids students may also be required to bring food. 

 

9.   Parental/Carer Responsibility

The Parent warrants and represents that:

1. The information set out in the Enrolment Form (whether or not completed and/or signed by the Parent) is accurate in all respects and the Parent/Carer will notify Kickeroos and Active8kids of any change in such information immediately.

2. When attending the Course, neither the Pupil nor the Parent/Carer will be suffering from any contagious illness, disease or anything similar thereto.

3. The Parent/Carer acknowledges and agrees that the Pupil shall be deemed to be under the direction, care and control of the Coach throughout the Course, whilst attending classes.

10. NSW Active Kids Vouchers

1. Kickeroos and Active8kids accepts Active Kids Vouchers

2. To claim your voucher, simply fill out the details in the online system provided to you

 

11. Privacy Policy

1. By enrolling your child/ren, you authorise Kickeroos and Active8kids staff to use photographs of participants taken in our program for publicity and advertising. 

2. By enrolling your child/ren, you authorise Kickeroos and Active8kids to retain enrolment information on a confidential database, which shall be removed only upon request. 

 

12. Marketing/Media/Photograph/Video Policy

1. I give consent for Kickeroos and Acttive8kids to take photographs or videos of my child which may be used for business, marketing, social media and/or other publicity use.  

 

13. Change in Policy

1. Kickeroos and Active8kids reserve the right to amend its terms and conditions, in whole or part, at its sole discretion. 

 

14. Limitation of Liability

1. Kickeroos and Active8kids do not accept any liability for personal injury, property damage or loss sustained by any child as a result of his or her participation in a program due to any cause whatsoever subject to negligence of Kickeroos and Active8kids, its directors or employees. 

 

15. General

1. Kickeroos and Activ8kids reserves the right to refuse or terminate enrolment to any child who poses a disciplinary problem to our coaches or disrupts the learning for other children. 

2. For health and safety reasons, Kickeroos and Active8kids do not permit eating in class. 

3. By enrolling your child/ren, you authorise Kickeroos and Active8kids staff to obtain such medical assistance as they see fit, when necessary and you also agree to incur the expenses attached thereof.

4. Any notices to be sent by either party to the other shall be sent by pre-paid recorded delivery or registered post or hand delivered to the address of the relevant party and shall be deemed to have been received by the addressee within 48 hours of posting if sent by post and immediately if hand delivered. Kickeroos and Active8kids do not accept service of documents by email or fax.

5. The failure by either party to enforce at any time or for any period any one or more of the obligations arising under these Terms shall not be a waiver of them or of the right at any time subsequently to enforce all the obligations arising under these Terms.

6. The Parent, in agreeing to the terms of this contract, consents to the data overleaf being shared with other companies in the Kickeroos and Active8kids Group.

7. These Terms constitute the entire agreement between the parties hereto and supersede all prior agreements and understandings between the parties. It is agreed that no statement, promise or inducement whether written or oral alleged to have been made by either party and which is no contained herein shall be binding or form part of this Agreement.

8. This entire agreement shall be governed by Australian NSW Law and shall fall under Australian jurisdiction.
